About Pamela K. Fulmer —
Lead Attorney and Managing Partner Tactical Law Group LLP was founded by Pamela K. Fulmer, a nationally recognized technology and commercial litigation attorney with more than 35 years of legal experience. Pam previously served as a partner at Jones Day, DLA Piper, and Dentons before founding Tactical Law Group to deliver senior-level representation with the focus and efficiency a boutique model makes possible. Pam has been recognized as a Super Lawyer since 2008 and is listed in The Best Lawyers in America for Commercial Litigation and Trademark Law. She has been consistently named an IP Star by Managing Intellectual Property magazine for more than a decade and has been recognized as one of the Top 250 Women in IP in the World. She earned her J.D. cum laude from UC College of the Law, San Francisco, and graduated Order of the Coif. Pam is an experienced attorney with a strong track record litigating complex intellectual property and commercial disputes, with particular depth in technology, software, and licensing matters. Her practice includes copyright, trademark, trade secret, and patent infringement actions, as well as privacy-related litigation and claims under the Lanham Act, including false advertising, unfair competition, and trade libel. Pam also regularly represents clients in high-stakes commercial litigation arising from enterprise software transactions, including disputes involving software licensing, failed or delayed system implementations, misrepresentation in technology sales, and breakdowns between software publishers and implementers. She has extensive experience handling breach of contract claims, fraud and misrepresentation, breach of fiduciary duty, breach of the implied covenant of good faith and fair dealing, and other business torts where complex technology and business risk intersect. Building on this background, Pam focuses a significant portion of her practice on ERP implementation and licensing disputes, helping companies navigate high-stakes conflicts involving enterprise software publishers and system integrators when mission-critical systems fail to perform as promised. In addition to her litigation practice, Pam has a great deal of experience defending audits by software companies including Oracle Corporation, where she has advised clients on various issues including VMware virtualization, as well as hosting and related alleged areas of under-licensing. She has worked with her clients to develop strategies to mitigate these positions and to push back successfully on the audit findings.
